Α. Introduction

  1. The non-profit association known as “DESMOS NON-PROFIT ASSOCIATION” and bearing the distinctive title “DESMOS” (hereinafter referred to as the “Organizer”), with Tax Identification Number 997460285, headquartered in Athens at 71 Athinon Avenue, is organizing this contest titled “DESMOS 21 for 21” (hereinafter referred to as “the Contest”), in accordance with the following terms of participation (hereinafter referred to as the “Terms”), which will be posted and updated, if necessary, (for example, in the event of an extension of the duration) during the Contest, on the website www.desmos.org (hereinafter referred to as the “Website”).
  2. The purpose of these terms is to set forth the requirements and general conditions for participation in the Contest for any interested party wishing to participate, the procedure for selecting the winners in the context of the Contest, and the description of the exact procedure and terms governing the redemption of the Contest Prizes, which are binding on the Contest winners.
  3. Participation in the Contest is effected upon completion of the ticket purchase and constitutes an automatic and unconditional acceptance of all, without exception, of the terms, conditions, and procedures of the Contest, which (terms, conditions, procedures): (a) fully bind the participants regarding the framework of their participation in the Contest, the framework for selecting the Contest winners, and the framework for redeeming the Contest Prizes, (b) are included in this announcement, and (c) are updated (for example, in the event of an extension of the Contest’s duration) on the Website without any further obligation on the part of the Organizer to notify participants of such amendments. Candidates are responsible for ensuring they are promptly informed of any changes to the Contest terms by visiting the Website. These terms and any updates thereto are filed with a notary public, with the date of their drafting certified.

Β. Duration, entitlement and method of participation in the Competition

  1. The total duration of the DESMOS 2021 Contest runs from Thursday, September 23, 2021, at 10:00 a.m. (Greek local time) through Tuesday, November 2, 2021, at 9:00 p.m. (Greek local time) (hereinafter referred to as the “Duration”).
  2. It is expressly stated that, following the conclusion of the Contest or any change to its duration, entries are no longer accepted, nor do they in any way bind the Organizer. In this case, by participating in the Contest, participants irrevocably accept that they do not acquire any right or claim against the Organizer, nor are they entitled to request either the continuation of the expired contest, the delivery of the undelivered prize, or any compensation.
  3. Anyone who has reached the age of 16 is eligible to participate in the Contest. For those under the age of 16, participation is permitted only with the consent of the person(s) persons exercising parental authority, while participation in the online chats provided as a Gift may take place only in the presence and under the supervision of one of the persons exercising parental authority over the minor participant. It is clarified that the Organizer is entitled, at any stage of the Contest and specifically after the winners have been selected, to request that participants and/or those selected as winners present a police ID to confirm compliance with the aforementioned requirement of being at least 16 years of age, which is a necessary condition for the winning participant to be eligible to receive the Contest Prizes. In the event that it is determined that the participant and/or, at a later stage, the declared winner is a minor and has falsely stated that they have reached the age of 16, they will be automatically excluded from the Contest process at whatever stage it is in, and if they have already been declared a winner, they will automatically forfeit the Prize they have won, without the Organizer being liable in any way for such disqualification and/or loss of the Contest Prize.
  4. Those wishing to participate in the Contest must visit the website www.ticketmaster.gr and successfully complete the process of purchasing the available raffle tickets, following the instructions described on the relevant ticket sales pages and set forth in these Terms. Each ticket grants the purchaser the right to participate in the Draw –Selection of Winners under the terms and conditions set forth in these Terms, to have a brief online conversation with one of the celebrities participating in the raffle. For each celebrity contributing the opportunity for a brief conversation as a Prize, a separate drawing will take place among participants who have successfully completed the purchase of raffle tickets for that celebrity. A prerequisite for the award of the Gift is the signature and acceptance by the respective winner of the Declaration of Acceptance and Execution of the Gift, which includes the terms and conditions under which the aforementioned brief interaction—via teleconference or online chat—with the celebrity will take place.
  5. Each participant may enter the Contest as many times as they wish throughout its duration by purchasing one or more raffle tickets for themselves or another celebrity.
  6. In the event that, in the Organizer’s sole discretion, an entry does not meet the specifications set forth above and/or the Terms and Conditions of the Contest, or if the entry constitutes, in the Organizer’s sole discretion, in and of itself the result of unlawful technical manipulation of its systems or, in general, fraud or improper interference by the participant or a third party, the Organizer may, at any time and at any stage of the Contest, disqualify the entry; in the event that an entry has already been declared a winner, the Organizer may revoke the prize for that entry.

C. Competition Prize

  1. A total of 21 winners will be selected from the Contest, who will win, as a Prize, the opportunity—subject to the terms and conditions of Section F—to have a brief online conversation, exclusively via video conference, with the famous personality for whom they have purchased a ticket (hereinafter the “Prize”).
  2. The Prize is specific and non-exchangeable; it cannot be replaced with another prize or redeemed for cash or other gifts, regardless of value. Similarly, the winner may not be substituted by another person for the purpose of participating in the conversation.
  3. To redeem the Prize, the winner is responsible for ensuring they have a suitable computer and internet connection capable of easily facilitating the brief online conversation via teleconference. The Organizer bears no responsibility for the security, quality, availability, or adequacy of the winner’s network and assumes no obligation nor is it liable for any malfunction or technical problem arising from technical issues or the telecommunications equipment of the subscriber who is declared the winner (for which the subscriber is solely responsible) and/or on relevant third-party communication platforms (e.g., Zoom, Skype, etc.), which may affect the use of the service required to conduct the online video chat provided as a Gift.
  4. The Organizer and any companies affiliated with it, their employees, and their managerial and administrative staff, shall bear absolutely no liability for any direct, indirect, moral, positive, or other type of damage arising from or related to the conduct of this Contest.

Furthermore, the Organizer bears no liability, criminal or civil, to any of the parties involved in the Contest (winner and celebrity) or third party for any accident that may occur and/or any kind of damage and/or injury, whether physical, material, or otherwise, that may be caused to them, whether directly or indirectly related to the Prize or the Contest, or for any other reason.

The Organizer is exempt from the obligation to award the Prize in cases where the terms and conditions of participation in the Contest have not been met in any way.

  1. The Prize must be redeemed exclusively within a period of twelve (12) months from the date the winner is announced and may not be transferred to any person other than those whose required credentials / credentials have been gathered within the specified time limits.
  2. Furthermore, the Organizer shall not be liable in the event of any delay in delivery or cancellation of the Prize due to force majeure and/or for reasons attributable exclusively to the actions or omissions of the individual.

D. Draw – Nomination of the Winners

  1. From among the valid entries in the Contest, following the procedure described above, 21 (twenty-one) winners will be selected from among the participants, following a random drawing for each Prize, and two (2) alternates in the order of their selection for each winner. A separate drawing will be held for each celebrity, at the conclusion of which, in accordance with the above, 1 (one) winner and 2 (two) runners-up will be selected.
  2. The winners and runners-up will be selected by randomly drawing their ticket numbers via an electronic drawing conducted through the random. org, which ensures that there is no human intervention in the process and which the Organizer cannot interfere with or influence. The generation of the relevant Excel file with sequential numbering per draw, as provided by the aforementioned electronic platform, from the admin page of www.ticketmaster.gr will take place in the presence of a notary public.
  3. The drawing to determine the winners will be conducted electronically on Wednesday, November 3, 2021, at 2:00 p.m. (Greek local time) at the office of the aforementioned notary public, in the presence of a representative(s) of the Organizer. If, for any reason, it is impossible to conduct the electronic drawing on the aforementioned date and time, the Organizer reserves the right to change the date and time of the drawing with prior notice.

E. Notification of Winners—Prize Claim

  1. The winners will be notified by phone and email to the details they have declared, where they will be asked for further contact and identity details. Each winner is obliged to respond within a period of 7 (seven) days from the above notification.

If a winner does not respond to a personal contact made by the Organizer via phone or email within 7 (seven) days of the date and time of the initial notification regarding the prize delivery process, by providing their full contact information (full name, mobile phone number, email, home address), in order to complete communication with them for the purpose of verifying their identity upon delivery of their Prize; or if it is determined that the appropriate conditions for their participation are not met, they forfeit the relevant right, in which case the Organizer is released from any obligation toward him.

  1. In the event that the winner is disqualified from receiving the Prize, the Organizer will contact the first (1st) alternate in the order of the draw in the same manner as specified in Section 1 of this chapter. If the first (1st) alternate does not respond to the Organizer’s communication within 7 (seven) days of the initial contact, the Organizer will then contact the next runner-up in the draw order, following the same procedure as set forth in Section 1 of this chapter, and the second runner-up must respond to the relevant communication within 7 (seven) days as described above. In the event that contact cannot be established with any of the alternates, the Prize will be canceled and the Organizer is released from any obligation under the Contest.

The Organizer will announce the winners on its website, via an Instagram comment, and in a Facebook post on Wednesday, November 3, 2021.

  1. The winner at any stage, even that of the utilization of the gift, can be canceled for the following reasons:

(a) if, for any reason, you do not fully accept these terms in their entirety—all of which are considered essential—and do not sign a relevant statement,

(b) if his participation does not meet any of the conditions set forth herein,

(c) if, in the Organizer’s reasonable judgment, the participant’s involvement constitutes, in and of itself, the result of unlawful technical interference with the Organizers’ systems or, more generally, fraud or improper interference by the participant or a third party,

(d) if any of the information provided is false,

(e) if, for any reason, attempts to contact the winner within a reasonable period of time following the drawing prove unsuccessful.

(f) in the event that, for any reason, the winner fails to appear as specified above, or appears late, or acts in a manner inconsistent with the use of the Prize.

  1. During the execution of the gift, the winner will have to show a police ID in order to make sure their identity as well as their age. In the event that the winner has not reached the age of 16, the execution of the gift is possible only in the presence of the person exercising parental responsibility. The winner assumes sole responsibility and timely planning for the settlement of the above details of the withdrawal of his / her gift. The organizer reserves the right to dispose at its sole discretion the prize that was not sought and / or received in a timely manner by the winner, in accordance with the above procedures and conditions, in which case it is exempt from any obligation towards the respective winner.
  2. The organizer is exempt from the obligation to perform the gift in cases where in any way the terms of participation in the competition have not been met.
  3. By submitting his / her participation in the competition, each candidate grants exclusively for the purposes of the competition to the organizer, without any charge of the latter, a non-exclusive license to use his / her name, image and any other necessary element related to his / her personality and identity for the purpose of using these elements in the context of advertising, promotional activities of the competition throughout the duration and after its conclusion. Indicatively, the organizer reserves the right to publish the image of the participants/ and their name, through photographic material, audio material and video recording material in print and electronic media (TV, magazines, Internet, social media such as Facebook, LinkedIn, News App etc.) and any other means chosen by the organizer in Greece and abroad, in the context of promotion, advertising exploitation of the competition and any event related to the presentation of the competition, such as the use of the gift, as archival material for its promotion in events seminars, lectures and similar activities of the organizer, etc.p.
  4. Each winner, by participating in the competition, unconditionally consents to the above without payment of any remuneration or compensation. Without prejudice to the above, the winner’s refusal to participate in a relevant advertising program or other announcement or refusal to include his or her name in entries, if so called, shall legitimize the organizer to refuse to grant the relevant gift, or to withdraw it. Participation in the competition implies explicit and unconditional consent of the participant to the entry of personal data concerning him in a file to be kept by the organizer, for the purpose and in the context of the conduct of the competition, in accordance with the provisions of the applicable national law and the General Data Protection Regulation (EU 679/2016).

F. Awarding of the Contest Prize

  1. The winner of each draw wins the opportunity to chat online (via the appropriate Zoom platform, Skype, Microsoft Teams) with the famous personality for whom he has purchased the valid winning ticket. In the event of failure of the winner to communicate with the organiser in the manner and procedure set out in clause E, the same right is acquired by the first runner-up and then, if communication with the first runner-up is not possible, the second runner-up follows. The chat will carry the following binding on the winner/runner-up features:

(1.a.) shall have a maximum duration of fifteen (15) minutes,

(1.b.) will be conducted online, specifically via remote means using the platform designated by the Organizer (such as Zoom, Skype, or Microsoft Teams) and through a specific link that the Organizer will send to the winner in a timely manner for this purpose, with the winner being fully responsible for the infrastructure, technical suitability, and knowledge required for a successful connection to the designated platform, as well as for the smooth operation of the connection during the conversation,

(1.c.) will have strictly predetermined content and will be specifically limited to questions posed by the winner to the celebrity, which will have been previously submitted to and approved by the Organizer and the celebrity, in accordance with the provisions of this chapter,

(1.d.) Only the winner and the famous personality with whom they will converse, and—for the purpose of ensuring proper compliance with the terms of use of the Prize—the Organizer’s representative with the supervisory responsibilities assigned in this section regarding the conduct of the conversation,

(1.e) Any video recording, audio recording, or reproduction of the content of the conversations is expressly prohibited without the Organizer’s prior written consent.

  1. The conversation may be scheduled within a period of up to twelve (12) months from the date of delivery by the winner to the organizer of the declaration of acceptance and execution of the gift provided for in Clause 3 of this chapter. The exact day and time of the conversation will be scheduled by the organizer according to the availability of the personality who will chat with the winner and taking into account – without the organizer being bound by it – the availability of the winner/runner-up. If, for any reason, it is not possible to agree a day and time due to the unavailability of the winner/runner-up, if the latter has been invited at least twice via email to participate in the conduct of the conversation on a predetermined day and time by the organizer, the organizer has the right to cancel the gift. If the winner / runner-up does not appear at the scheduled time and day on the agreed online medium, the organizer has the right to cancel the gift.
  2. A condition for the performance of the gift and the implementation of the above mentioned conversation, is the acceptance and signature of the written declaration of acceptance and execution of the gift, in which the terms and conditions of participation in the execution of The Gift are set and the acceptance of which is an essential condition for the performance of the gift to each winner. After the winner has been declared, the organiser must, within a reasonable time, deliver the above document to him, and the winner is obliged to sign each page of the above document and put his name and signature at the end of it in writing and obtain on them an endorsement of the authenticity of the signature by a public authority, and then to deliver it at his own expense to the organiser in original form. Refusal or failure to fulfil the above obligations on the part of the winner grants the organizer the right to exclude the winner from the prize without any claim of the winner against the organizer.
  3. For this conversation, each winner, or runner-up in the event of unavailability of the winner, must submit in writing by email to the organizer the questions he wishes to address to the famous personality, which are agreed to a maximum of 10 questions, within a period of ten (10) days from the date on which he will be invited by the organizer to submit these questions. If the winner does not submit his questions in time, his participation will be canceled, and the organizer will then contact the next runner-up in order of draw as above. In the event that communication is not possible with any of the runners-up, then the gift will be canceled.
  4. The content and number of questions are at the sole discretion of the organizer, as well as at the sole discretion of the person to whom the conversation is being implemented. The submission of questions will be preceded by the written consent of the organizer to the winner, which will also be granted by email, and no question may be submitted by the winner, if this has not previously received the written consent of the organizer, in which (Consent) will contain precisely the exact content and number of questions that the winner is allowed to submit. In the event that any or all of the questions are deemed to be inappropriate, the winner has the right to submit the questions again after correcting, replacing or removing the inappropriate questions and sending in a timely manner and within one (1) day from the relevant notice to the organizer for approval these revised questions
  5. Questions will not be accepted with content, among other things, that offends public decency and morality or presents ambiguities or other technical defects. In addition, questions with content relating to personal data (sensitive and non-sensitive) of the participating personality will not be accepted. Also, entries that contain offensive to honor and dignity content against public or administrative or ecclesiastical authority or any third party), abusive, inflammatory, racist, or object in the applicable provisions or in any other way improper in the absolute discretion of the organizer.
  6. In the event that the winner by submitting the questions or during the conversation, at the absolute discretion of the organizer:

(a) offends the character, morals, honor, dignity, or integrity of the person with whom they are speaking, and/or concerns personal data (whether sensitive or not),

(b) deviates from the approved questions, topics, standards of decency, and the preservation of public decency,

(c) posts content that is abusive, inflammatory, racist, or in violation of applicable laws, or is otherwise inappropriate,

(d) violates any of the specifications and/or obligations set forth in this chapter regarding the conduct of the conversation,

will be immediately excluded from the process of redeeming the Gift, regardless of the stage at which it is currently in; furthermore, the Organizer’s representative may, at his or her sole discretion, provided that the violation occurs during the course of the conversation, to proceed at his sole discretion and without prior notice to the winner/runner-up to terminate the ongoing conversation. It is specifically clarified that, in addition to the Organizer, the famous personality participating in the conversation also retains this right for the same reasons. In this case, the winner and/or runner-up shall have absolutely no claim against the Organizer and/or the celebrity (including, but not limited to, compensation, monetary satisfaction, and/or a claim for the conversation to be repeated), and they will be permanently disqualified from any further phase of the Contest, with the Organizer being entitled to claim against them compensation for any material damage and/or moral harm resulting from the violation of the terms governing the conduct of the conversation, as set forth in this section of the Contest Terms.

G. Amendment of Terms and Conditions

The Organizer reserves the right, for good cause, to unilaterally change the terms and the Prize at any time, or to postpone or cancel the Contest and the drawing, without prior notice. In such a case, the Organizer shall not be liable for any compensation to participants, winners selected in the drawing, and/or any third party.

H. End of the Contest

Upon the conclusion of the Contest, as well as the completion of the process of selecting the winner and awarding the Prize as set forth in Terms E and F above, all obligations of the Organizer toward the winner and the two runners-up shall cease to exist. Upon the conclusion of the Contest and the fulfillment of the Prize, the Organizer shall have no further obligations toward the participants.

By participating in the Contest, the participant grants the Organizer his or her unconditional permission and consent to use and process personal data for the purposes of the Contest in accordance with the specific provisions set forth in these terms.

Participation in the Contest constitutes the participant’s explicit and unconditional consent both to the recording of personal data concerning them in a file maintained by the Organizer and to the processing of such data, in accordance with the provisions of applicable national legislation and the General Data Protection Regulation (EU 679/2016), within the framework of conducting and achieving the purpose of the Contest.

With regard to the winner of the Contest and any runners-up, the Organizer hereby informs that it will process their personal data, which will be provided by www.ticketmaster.gr and by the participants themselves, for the purpose of notifying them and publishing the results of the Contest, the general promotion and presentation of the Contest, in accordance with the specific provisions of these Terms, as well as to take all necessary actions for the fulfillment of the Prize.

After the Prize has been awarded and the Contest has ended, any data—whether personal or otherwise—pertaining to the participants, the winner, and any runners-up in the Contest, which was collected in connection with this Contest, will be destroyed.

Should the winner of the Contest and/or any runners-up wish to exercise their rights under the provisions of national law and the General Data Protection Regulation (EU 679/2016), the latter may contact a representative of the Organizer or send a relevant inquiry to notifications.desmos@gmail.com.

I. Acceptance of Terms – Jurisdiction – Governing Law

Participation in the Contest constitutes full and unconditional acceptance of all of these terms and conditions, the drawing procedure and the results of the drawing, the procedure for selecting the winner, and the fulfillment of the Prize. The winner may be disqualified at any stage for the following reasons: a. if, for any reason, they fail to receive/accept the Prize and do not sign the Declaration of Acceptance and Execution of the Prize, b. if, for any reason, they do not fully accept these terms in their entirety, all of which are considered essential.

Any dispute that may arise regarding the Contest and the application of these Terms shall first be resolved amicably by a committee selected by the Organizer. Furthermore, for any dispute that cannot be resolved as set forth above in connection with the aforementioned Contest, the Courts of Athens shall have exclusive jurisdiction, and Greek law shall apply.
